Service Animal Policy

Allergy Associates of Hartford PC’s goods, services, and facilities are provided to all individuals with disabilities, including individuals who use service animals.  Such policies, practices or procedures enable Allergy Associates to meet its anti-discrimination obligations to all of its clients with disabilities, including those use service animals and those whose allergies substantially limit a major life activity, including the major bodily function of the immune system.  Allergy Associates’ policies, practices or procedures include the following information and requirements:


  1. Allergy Associates recognizes that a service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability.  Other species of animals, trained or untrained, are not service animals for the purposes of this definition.  The work or tasks performed by a service animal must be directly related to the individual´s disability.


  1. Allergy Associates recognizes that individuals with disabilities shall be permitted to be accompanied by their service animals in all areas of Allergy Associates’ facilities where other Allergy Associates clients are allowed to go, subject to certain protections and protocols that protect persons who are allergic to dogs as described in sections e-f, below.


  1. Allergy Associates may make two inquiries to determine whether an animal qualifies as a service animal, if not readily apparent.  Allergy Associates personnel may ask if the animal is required because of a disability and what work or tasks the animal has been trained to perform.  Allergy Associates shall not require documentation. 


  1. Allergy Associates may ask an individual with a disability to remove a service animal from the premises if the animal is out of control and the service animal’s handler does not take effective action to control it or if the animal is not housebroken. 


  1. Allergy Associates is not required to permit an individual with a disability who uses a service animal to access its goods, services, or facilities, where the presence of a service animal poses a direct threat to the health or safety of others.  In determining whether a service animal will pose a direct threat to the health or safety of others, Allergy Associates must make an individualized assessment, based on reasonable medical judgment that relies on the current medical knowledge or on the best available objective evidence, to ascertain:


  1. The nature, duration, and severity of the risk;
  2. The probability that the potential injury will actually occur;
  3. Whether reasonable modifications of policies, practices or procedures will mitigate the risk.


  1. If a service animal is properly excluded, including if Allergy Associates demonstrates that it would be a fundamental alteration to the nature of its goods and services, or a direct threat to the health or safety of others applying the factors set out in paragraph e above, Allergy Associates shall give the individual with a disability the opportunity to obtain Allergy Associates’ services without having the service animal on the premises.


  1. Allergy Associates’ patient intake and appointments system for its facilities enables its personnel to take precautionary measures, as necessary, to ensure that no individual is discriminated against on the basis of disability.
